In particular, you must comply with all relevant regulations that apply to a house in multiple occupation including the requirement to obtain a licence for the property and/or you. If for any reason you cannot comply with these regulations you must inform us immediately. (e) The property must not be let to : · anyone possessing any form of diplomatic immunity; · anyone receiving any DSS benefits; · anyone who is a relative of you; and/or · any letting to a company of any form who then sublet. (f) The property may only be let on one of the following types of tenancy: i) A single assured shorthold tenancy (or in Scotland short assured tenancy) (AST) for a fixed term of no more than 12 months. Where a new AST is to be granted, the following notices must be served before the tenancy is completed: · in England & Wales, under Grounds 1 and 2 of Schedule 2 of the Housing Act 1988 (as amended); · in Scotland, under Grounds 1 and 2 of Schedule 5 of the Housing (Scotland) Act 1988 and notice of short assured tenancy agreement under s32 Housing (Scotland) Act 1988; · in Northern Ireland notices are not required. Where you are not letting the property immediately or the property is subject to an existing tenancy then our solicitor must obtain an undertaking from you to serve these notices in any future lettings. ii) If the tenancy would be an AST except for the fact that the rent received for letting the property exceeds £25,000, our solicitor must ensure that the tenancy agreement that the property may be subject to on completion is not one that will grant the tenant any security of tenure that is in excess of that security that would be granted by an assured shorthold tenancy. Where you are not letting the property immediately or the property is subject to an existing tenancy then our solicitor must obtain an undertaking from you to serve these notices in any future lettings. iii) Letting to students as prescribed by Schedule 1 to the Housing Act 1988 (i.e. the property must be let through a university or other publicly funded institution of further or higher education) for a term of no more than 12 months. Lettings direct to students are also acceptable provided they satisfy paragraph (f)(i) of this offer condition. iv) Letting to a local authority or a registered social landlord (i.e. housing association) for a term of not more than 5 years. We will not accept letting where the tenant is a company who lets to a local authority or a registered social landlord. v) Letting to a UK registered limited company who in turn allows one of its employees (and their immediate family) to reside at the property under licence only while employed by the limited company. If you wish to grant a tenancy other than as specified in this offer condition, our specific consent must be obtained before doing so; (g) All tenancy agreements must be on the basis that the rent is paid monthly and that no premium is paid. (h) In any tenancy to a local authority, registered social landlord (i.e. housing association) or Limited Company our solicitor must ensure (for letting during the mortgage term you must ensure) that : · you give to the tenant irrevocable authority to pay rent and all sums due under the terms of that tenancy direct to us if, at any time, we ask the tenant to do so; and · in paying such sums direct to us the tenant would be complying with its obligation to pay those sums to you. (i) If at any time we ask the tenant to pay money direct to us in accordance with paragraph (j), you give us irrevocable authority to to use the whole amount to reduce the debt. The total amount paid will relate to the property and not to any furnishings or other items on it. (j) All tenancies must be fully set out in writing, all of you must sign the tenancy agreement as landlord and our solicitor must ensure that any letting will satisfy these letting conditions and that it otherwise does not prejudice our security. If our solicitor cannot comply with this they must inform us prior to completion, setting out the risks and their recommendations. |
